Entry conditions for the “Find the Raven!” competition

The following Entry Conditions apply to the “Find the Raven” competition, organized by LOBA GmbH & Co. KG (referred to hereafter as "the Organizer"), Leonberger Str. 56-62, 71254 Ditzingen. For additional contact details, please see our Legal Notice at www.loba.de.

Microsoft Forms shall be used for participation in the competition. For details of the prizes themselves, the entry deadlines, and the way in which prizes will be awarded, please refer to the competition Organizer's announcement on Customer Voice.

1 Scope

1.1 These Entry Conditions apply to the "Find the Raven!" competition.

1.2 The Entry Conditions below include the conditions applicable between the competition entrants and the competition Organizer unless amended by written agreements between the parties in accordance with clause 14.1. of these conditions.
1.3 You cannot enter the competition unless you accept these Entry Conditions. In compliance with the law, entrants are referred to these Entry Conditions before entering the competition.
1.4 If you enter the competition, the Entry Conditions as indicated on your entry date apply.
1.5 The Entry Conditions also apply to entrants applying from outside the Federal Republic of Germany. Entrants expressly accept the Entry Conditions, and the place of jurisdiction as Germany.

 

2 Eligibility to enter

2.1 Eligible to enter are commercial direct customers of LOBA and commercial customers of LOBA dealers. Customers of online dealers are excluded.
2.2 Persons from all countries may participate in the competition.
2.3 Entries are only valid if the person entering the competition is at least 18 years of age on the date of their entry and is permanently resident in one of the above-mentioned countries specified by the Organizer. Entrants must also have their own email address and be able to use it.
2.4 Employees of LOBA GmbH & Co. KG and its subsidiaries and other affiliated companies, their Sales organizations, their relatives, their suppliers and agency workers are not eligible to enter the competition. The same applies to anyone disqualified from entering under clause 8 of these Entry Conditions. Anyone who breaches these requirements will not be able to claim against the Organizer.
2.5 Entries are only valid if the entrant's user data is correct. Entrants are liable for entering false information in their personal data and indemnify the Organizer against any resulting third-party claims.
2.6 Please note that to enter the competition, you must provide the data listed in clause 3. The data required in order to run the competition are collected and stored by us in accordance with regulatory provisions. For details, please see our separate Privacy Statement.

 

3 Entry

3.1 Entry to the competition is free of charge.
3.2 Each entrant can enter the competition once only. Entering in the name of a third party or nominee is not allowed. The winner has sole liability for the payment of any taxes due.
3.3 Microsoft Forms is used for participation and all fields marked as mandatory (*) must be filled in when entering. If an entrant wins a T-shirt and the entrant’s address data is not provided, the address data will be requested.

3.4 When participating, the page on which the stuffed toy raven has been printed must be entered in field 8. Important: We are looking for the stuffed toy raven.
3.5 Each entrant can only register once and can only enter one prize draw.
3.6 Entrants are only entitled to be placed in the draw if they registered on the Organizer Domain by midnight on the last day of participation via Microsoft Forms. The system time of the server applies.
3.7 Every entrant who registers correctly and by the deadline will be placed in the draw as per the competition announcement.
3.8 Late entries on Customer Voice will be deemed invalid. As such, entries that are not received by the deadline under 3.5 will not be taken into account in the draw.
3.9 Entries received after the competition closure date cannot be taken into account in the draw.

 

4 Prize draw and prizes

4.1 The competition opens on 17 April 2023.
4.2 The competition closes on 30 June 2023. The draw will take place in July 2023.
4.3 The prizes are as follows:

10 LOBA KIDS JUBI SHIRTS (available in various sizes).

The shirt will be sent by postal mail.

4.4 The winners will be determined by drawing lots from among the entrants duly registered by the day of the draw.
4.5 Failure to respond to a prize notification shall void the entitlement to a prize. In this case a replacement winner will be drawn from among the entrants eligible on the day of the draw.

 

5 Notifications: entrants, winners and claiming a prize

5.1 Winners will be notified by LOBA.
5.2 All winners must contact the Organizer with their personal data within two weeks of receiving the draw notification. Failure to do so voids the entitlement to a prize.
5.3 If the data provided matches that stored in Microsoft Forms, a prize will be awarded as per these conditions. If no personal data is provided, the data will be provided by email upon notification.
5.4 In the event of a dispute, especially if the person's name does not match, the data stored in Microsoft Forms is definitive.
5.5 The prizes advertised are for the competition. The rules stipulated in the advertising apply.

 

6 Forfeiture of a prize

If a prize notification fails because its delivery to the address details provided is unsuccessful or the winner cannot be reached at the telephone number provided after at least three attempts, and, if these were unsuccessful, the winner fails to call back within ten working days, the entitlement to the prize is forfeited. If the entrant provides an address (post or email) this will be the preferred means of sending the notification. If the notification cannot be delivered to the address provided (email or postal address) the entitlement to a prize is considered forfeited. A prize notification is also considered unsuccessful if a request by email, post or telephone to provide a current address for delivery of the prize notification within two weeks remains unanswered.

 

7 Constraints and taxes

The entitlement to a prize cannot be passed to a third party. The right to receive the prize in cash is excluded unless cash prizes are awarded. Where there is a tax claim from the tax authorities, the winner must pay any taxes that may be incurred.

 

8 Rules of conduct, disqualification and blocking

8.1 The Organizer or its service provider has the right to disqualify and exclude from the competition any entrants who influence the entry process in a way that violates good faith, e.g. by manipulating the software or violating the rules of the game, or whose conduct is in any other way unreasonable, e.g. threatening or unreasonably harassing (insult, slander, telephone harassment by making frequent calls, etc.) employees of the Organizer or its service providers.
8.2 Furthermore, the Organizer or its service provider can exclude entrants at their discretion in advance if there is a risk of violation of the rules of conduct set out in clause 8.1.

 

9 Termination and amendment options

9.1 The Organizer reserves the right to cancel or terminate the competition at any time without notice if this is in the Organizer's legitimate interests, for example due to technical problems or legal concerns.
9.2 The Organizer reserves the right to amend the Entry Conditions.
9.3 The Organizer reserves the right to cancel the competition in full or in part (for example particular prizes or special draws) after one prize draw and prize giving. This applies in particular if for some reason the draw cannot take place on schedule, for example computer viruses, software or hardware failures and/or other technical and/or legal grounds that have an impact on the management, security, integrity and/or the due and proper implementation of the draw.
9.4 The Organizer reserves the right to limit access to the Organizer Domain, in particular for technical reasons (e.g. repairs and maintenance) or to suspend access temporarily. User account overload during or due to system failures may also cause the website, certain services or user accounts to crash briefly. No claims may be brought against the Organizer if this occurs. In particular, we accept no liability for emails or data entry (in website forms) that do not comply with the stated requirements and are consequently rejected by the system. Furthermore, the Organizer is not liable in the event of theft or destruction of the systems and/or storage media storing the data or in the event of unauthorized change and/or manipulation of the data in the systems/storage media by competition entrants or third parties.

 

10 Legal action

Legal action in relation to entering the competition is excluded. There is no enforceable claim to the payment of prizes.

 

11 Data privacy and consent

Competition entrants must provide personal data. We will process these data with great care and in compliance with data protection regulations.
Entrants warrant that the data they enter, especially first name, last name and email address, company name, company address and telephone number are correct and genuine.
Entry to the competition, and entering all of the associated personal data required, is voluntary.
The Organizer's permission to process the personal data of entrants is provided for in Article 6(1)(a) of the General Data Protection Regulation (GDPR).
The Organizer will only use the data for the purposes of organizing and running the competition. Competition winners agree to the processing of their personal data for promotional purposes.
Data will be erased when its purpose is fulfilled, or kept for a legally specified period of time.
The Organizer expressly refers to the information and data subject rights to which entrants are entitled (e.g. right of objection according to Article 21 GDPR, duties of information for the collection of personal data according to Article 13 GDPR), which can be viewed at any time by visiting https://www.loba.de/datenschutz/.

 

12 Liability

12.1 Where the Organizer has links to the websites of partners, sponsors and promotional partners, it has no influence over the linked sites and no responsibility for them.
12.2 Liability for data loss is limited to the typical recovery work that would have occurred if backup copies had been made regularly and in line with the risk.

 

13 Severability clause

Should individual provisions of this contract be ineffective or unenforceable, or become ineffective or unenforceable after the conclusion of the contract, the validity of the rest of the contract remains unaffected. The invalid or unenforceable provision will be replaced by a valid and enforceable provision whose effects come closest to the economic objective originally pursued by the contracting parties. This applies in particular if a loophole in the contract comes to light.

 

14 Final provisions

14.1 Amendments or additions to these Entry Conditions must be made in writing. This also applies to lifting the requirement for amendments or additions to be in writing. The competition is subject exclusively to Federal German law.
14.2 If the entrant is a merchant as defined by the German Commercial Code, a legal entity under public law or a special fund under public law, the place of jurisdiction for any disputes arising in the course of managing this contractual relationship is the place of jurisdiction of the Organizer's registered office.
